TERMS AND CONDITIONS OF USE

ARTICLE 1: PURPOSE
The purpose of these general terms and conditions of use (hereinafter referred to as “GTCU”) is to provide a legal framework for the provision of the Site and the services of the www.bibent.fr Site (hereinafter referred to as “LE BIBENT” or “the Site”) and to define the conditions of access to and use of the services by the “User”. These GCU are accessible on the Site under the heading “GCU”. The GCU must be accepted by any User wishing to access the Site. They constitute the contract between the Site and the User. Access to the Site by the User implies acceptance of these GCU. The User hereby undertakes to comply with these conditions. Any registration or use of the Site implies the User’s unreserved and unrestricted acceptance of these GCU. When registering on the Site via the Registration Form, each User expressly accepts these GCU by ticking the box preceding the following text: “I acknowledge having read and understood the GCU and I accept them”. In the event of non-acceptance of the GCU stipulated in the present contract, the User must renounce access to the services offered by the Site.
ARTICLE 2: DEFINITIONS
The purpose of this clause is to define the various essential terms of the contract:
– User: this term refers to any person who uses the Site or any of the services offered by the Site.
– User Content: this is the data transmitted by the User via the Site’s contact form.
ARTICLE 3: ACCESS TO THE SITE
The Site provides the User with free access to the services offered by LE BIBENT. The Site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at the User’s expense. Depending on the case : The Site makes every effort to ensure quality access to its services. As the obligation is one of means, the Site does not undertake to achieve this result. LE BIBENT cannot be held responsible for any force majeure event resulting in network or server malfunction. Access to the Site’s services may be interrupted, suspended or modified at any time without notice for maintenance or any other reason. The User undertakes not to claim any compensation as a result of any interruption, suspension or modification of this contract. The User is responsible for updating the information provided. He/she is informed that he/she can modify it by logging into his/her member area.
To access the services, it is not necessary to create a User account.
LE BIBENT shall not be held liable for any event due to force majeure resulting in malfunction of the Site or server, subject to any interruption or modification in the event of maintenance. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without notice.
The User may contact the Site by e-mail at the publisher’s e-mail address indicated in the legal notice.
ARTICLE 4: INTELLECTUAL PROPERTY
Trademarks, logos, signs and all Site content (text, images, sound, etc.) are protected by the French Intellectual Property Code, and more specifically by copyright.
The BIBENT trademark is registered with the Institut National de la Propriété Intellectuelle. Any representation and/or reproduction and/or partial or total use of this trademark, of any nature whatsoever, is totally prohibited.
The User must request prior authorization from the Site for any reproduction, publication or copy of the various contents. The User undertakes to use the contents of the Site in a strictly private context; any use for commercial or advertising purposes is strictly forbidden.
Any total or partial representation of this Site by any process whatsoever, without the express authorization of the Website operator, constitutes an infringement punishable by article L 335-2 et seq. of the French Intellectual Property Code.
In accordance with article L122-5 of the French Intellectual Property Code, Users who reproduce, copy or publish protected content must cite the author and source.
ARTICLE 5: LIABILITY
The sources of the information published on the www.bibent.fr site are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.
The information communicated is presented for information purposes only and has no contractual value. Despite regular updates, the Site cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the Site cannot be held responsible for the use and interpretation of the information contained in this Site.
The Site cannot be held responsible for any viruses that may infect the computer or any other hardware of the Internet user, following use, access or downloading from this Site.
The Site may not be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
ARTICLE 6: HYPERTEXT LINKS
Hypertext links may be present on the Site. Users are informed that by clicking on these links, they will leave the www.bibent.fr site. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.
ARTICLE 7: PERSONAL DATA COLLECTION
The Site ensures that the User’s personal information is collected and processed in compliance with the French Data Protection Act no. 78-17 of January 6, 1978.
The privacy policy is an integral part of the GTU and the User expressly accepts it without reservation.
In accordance with the French Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete and object to his or her personal data. The User may exercise this right by sending an e-mail to donnees-personnelles@ladepeche.fr.
ARTICLE 8: COOKIES
The User is informed that when visiting the Site, a cookie may be automatically installed on his/her browser.
Cookies are small files stored temporarily on the hard disk of the User’s computer by your browser and which are necessary for the use of the LE BIBENT Site. Cookies do not contain any personal information and cannot be used to identify anyone. A cookie contains a unique identifier, randomly generated and therefore anonymous. Some cookies expire at the end of the User’s visit, others remain.
The information contained in cookies is used to improve the Site, for example by :
– enabling a service to recognize the User’s device, so that he or she does not have to give the same information over and over again, e.g. to fill in a form or a survey.
– remembering that the User has already given his/her login and password, so as not to have to do so again on each new page.

By browsing the Site, the User accepts them.
In the absence of acceptance, the User is informed that certain functions or pages may be refused.
The User may deactivate this cookie using the settings in his/her browser software.
ARTICLE 9 : MAJOR FORCE
The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the case law of French courts and tribunals: total or partial strikes, confinement, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, acts of terrorism, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer failure, blockage of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties preventing the normal performance of the contractual relationship.
All of the parties’ obligations will be suspended for the duration of the force majeure event, without any liability for damages. The parties are released from their obligations.
ARTICLE 10: APPLICABLE LAW AND JURISDICTION
This contract is governed by French law. In the event of failure to resolve a dispute between the parties amicably, the French courts shall have sole jurisdiction.

ARTICLE 11: UPDATING AND AMENDING THE GGU
LE BIBENT reserves the right to modify or adapt these terms and conditions of use at any time without prior notice.
Users are invited to consult the GCU on a regular basis. If necessary, in the event of significant modifications, users will be informed of these modifications by any means deemed appropriate. Use of the SITE after publication of these modifications implies acceptance of the new terms and conditions of use.
